General Information: The terms & conditions highlighted in this document have been formulated to accommodate Tanya Tours Canada Inc. and its clients in the best interest of both the parties with utmost transparency and fairness.
Tanya Tours Canada Inc. in return for full payment made by the client (you) of the amount specified, shall arrange for the transportation, accommodations, and other services specified (in the Booking Form and any supplemental documents) and as included in this document as and to the extent you have selected them, and subject to the following terms and conditions.
PROCEDURES: On finalisation of your plans, please read the terms and conditions below as your tour/booking is subject to these Terms and Conditions. A contract is formed once your signed Booking Form and deposit is received by Tanya Tours Canada Inc. as we accept and confirm the booking. Please note that travel arrangements are not confirmed until slated in writing by Tanya Tours Canada Inc.
BANK DETAIL / WIRE TRANSFER INFORMATION: All payments will be made through a wired bank transfer in Canadian Dollars or as specified or agreed by both parties. Tanya Tours Canada Inc. is proud to be Associated with the RBC Royal Bank of Canada for which the details of the bank account will be made available on confirmation on the tours or specified services.
PAYMENT: While booking a tour package 20% (Non Refundable) of the tour price per person will be required along with the booking form. The balance of the cost must be paid and received in 60 days prior to the first day of the tour unless otherwise agreed by both parties. If the final balance is not received on time, Tanya Tours Canada Inc. reserves the right to nullify the booking as cancelled by you. If the booking is cancelled by you in this manner, your deposit shall be treated as a cancellation charge to cover the cost incurred by Tanya Tours Canada Inc. If you book the tour within 60 days prior to first day of the tour, the full amount must be paid at the time of booking. On receipt of full payment all sales of tour packages and services will be full & final therefore no refund / cancellation will be applicable and or according to the Terms and Agreement of our Suppliers.
Force Majeure: Tanya Tours Canada Inc. reserves the right to cancel the tour and/or to make changes to the travel arrangements. Such cancellations and/or changes are sometimes necessary due to unforeseen circumstances beyond our control. If your tour is cancelled, we will notify you in writing at the earliest possible date and will refund all amounts you have paid to us. OUR LIABILITY IN SUCH A CASE IS LIMITED. If we make major changes prior to your departure, you have the right to cancel and receive a full refund. If a major change is made, we will notify you at the earliest possible date and may cancel the tour in writing up to the date of the commencement of the tour. If you do not notify us in writing of a cancellation, then you shall have accepted the changes.
In an eventuality, non-major changes may be made to your travel arrangements for which we reserve the right to do at any time and we will advise you accordingly. These changes may be the result of force major or similar reasons beyond our control ie delays in departure, inclement weather conditions, over bookings or closer of a hotel, strikes, riots, decisions by provincial government or tourist organizations, altering the itinerary, the duration of time spent at a location or even omitting a destination or part of the itinerary due to prevailing local situation. In such a scenario we shall offer comparable alternative arrangements wherever possible.
PRICES: All prices are based on CAD Canadian Dollars. Once your booking is accepted by us, we will not make any changes to your price after you have paid the final balance. Prior to the time you pay the final balance, we may revise the tour solely due to increased transportation costs, including costs of fuel and any currency fluctuation. No such revisions shall amount to more than 7% of the tour price. If you do not wish to accept the changes, you’ll be entitled to cancel the tour with a full refund of all amounts you have paid us. OUR LIABILITY IN SUCH A CASE IS LIMITED TO A RETURN TO YOU OF ANY AMOUNTS YOU HAVE PAID TO US.
RESPONSIBILITIES: Since Tanya Tours Canada Inc. does not own or operate any of the accommodation or transportation or other facilities used in connection with the tours we therefore are not liable for the conduct, actions or negligence of those parties or their staff, employees or agents. We accept responsibility for our employees only. When you travel with an airline, the conditions or carriage of that airline will apply to you and the airlines.
Those conditions are subject of International Agreements and may limit or exclude liability. Tanya Tours Canada Inc. makes arrangements with airlines, hotels and other independent parties to provide you with the travel services included in the tour. These parties are independent suppliers over whom we have no direct control. We are not liable for personal injury, property damage or for any other loss, claim or damage in the event of any failure by any person or company to render any transportation, accommodation or travel service which is part of the tour, or for the expenses incurred due to delays caused by weather, strikes, war, civil disturbances, natural disasters, flight delays, government actions, mechanical failures, acts of God, or any other such condition or event. We cannot and do not assume any responsibility or liability for flight delays, cancellations or missed connections and are not liable for any expenses or consequences resulting there from. In no event shall Tanya Tours Canada Inc. be responsible for incidental or consequential losses or damages or any other kind of related losses etc.
DISCLAIMER: You, and each party traveling in your tour and named in the booking form, expressly acknowledge that you are cognizant of all risks of travel and arrangements for trips of this nature and fully disclaim, waive and Tanya Tours Canada Inc. (including its officers, members, directors and employees) from any and all liability, claims, damages, loss or responsibilities (including damage to or loss of your property or your injury or death) with regard to the proposed tour and arrangements made with respect thereto, even if caused by the negligence of any airlines, transportation companies, hotels or any other party rendering any of the services or accommodations included in the tour. Tanya Tours Canada Inc. including its complete team members shall similarly not be liable for any claims, losses, damages for delay of baggage or other properties, inconvenience, loss of enjoyment, upset and disappointment, distress or frustrations whether physical or mental, resulting from any act or omission of any other party providing services to you. In the event of a service being withdrawn by any party who is to provide a tour service or accommodation, Tanya Tours Canada Inc. shall have no responsibility and our sole obligation shall be to make an appropriate refund to you commensurate with the nature of the service or accommodation which has been withdrawn. All services and accommodations are subject to the laws, customs and regulations of the countries in which these services are rendered. You acknowledge that you and each member of your tour group are solely responsible for determining that you are in sufficient good health to undertake the tour. You also acknowledge that you are aware that conditions in other destinations are not as similar in North America and that you understand and assume the risks associated with traveling in some countries. As an example, vehicles are not likely to be equipped with seat belts or other passenger restraints. You also acknowledge that parties who might require special assistance may have to make their own arrangements and should consider whether the tour is appropriate for them. There are some countries who do not have special accommodations such as ramps for wheelchairs nor does it have special accommodations for the blind or deaf. If your tour includes any bus transportation, you should be aware that there may be a minimum age (usually 8 years old) for such travel. It shall be your obligation to make us aware of any such situations. If a particular hotel is unavailable, an equivalent hotel of the same standard shall be offered.
PASSPORTS AND VISAS: All passengers and travelers are responsible for securing proper documentation prior to joining the tour. Passengers & travelers are advised to check with respective consulates and/or visa agencies for full details. Tanya Tours Canada Inc. will not be held responsible for any technical lapses in the travelling documents and holders of the said documents will be solely themselves responsible.
ADDITIONAL GUIDELINES/INFORMATION: Travel insurance is an important aspect of a travel plan hence every client must pay attention towards getting it prior to travel. Tanya Tours Canada Inc. will advise the client accordingly, however the onus lies on the client to acquire it or not. At no stage Tanya Tours Canada Inc. will be held liable for any eventuality. A certificate to this effect will be obtained duly signed by the client as per the invoice agreement. On acceptance of your booking we will issue a confirmation invoice. A contract will exist between us from the date we issue the confirmation invoice. This offer cannot be used in conjunction with any other discounts or special offers unless specified. The discount can be applied to land bookings only and cannot be applied to airfares, travel insurance, extra or additional accommodation, single supplements, visa or any additional compulsory payments required. Trip prices and itineraries are subject to change at any time, including after booking. If there is a significant price change to a trip that is outside the control of Tanya Tours Canada Inc. (for example a significant increase in third party service provider costs), travellers may need to be re-invoiced at the new price. Any discount will still apply to the new price.
LEGAL JURISDICTION: Tanya Tours Canada Inc. will be abided under Federal and Provincial laws for any litigations or disputes. In case of any disputes or litigations with other parties shall be dealt in Provincial courts of Ontario only and no other location/city/country.
YOUR TOUR PRICE EXCLUDES: Travel costs to arrive at the starting point of the tour. The cost of personal items such as laundry, drinks, incidentals etc. Airport security charges if levied by any airport to cover the cost of security arrangements. Cost of travel from place of residence to the city of international travel unless specified. Also excludes International Airfare & Airport taxes, Optional excursions, Costs of visas and passports, Gratuities for service provided on a personal basis, Meals other than specified and any Airline Excess baggage charges or unless otherwise agreed.
TERMS AND CONDITIONS: The payment of your deposit shall constitute consent to all provisions contained under this general information, terms and conditions. Tanya Tours Canada Inc. reserves the right to modify this Agreement at any time, and without prior notice.
